This is how most people in El Paso County meet radon. The inspection comes back above 4 pCi/L, there are a handful of days left on the objection deadline, and suddenly a number nobody was thinking about is a negotiation.

Under the Colorado Contract to Buy and Sell Real Estate, the buyer pays for inspections and testing. Who pays for mitigation is a negotiation like any other repair request, and it is commonly split, credited at closing, or handled by the seller before possession. There is no statute assigning it to either party.

Colorado sellers do have a disclosure obligation. The Seller's Property Disclosure asks about known radon concentrations and any prior mitigation, and since August 2023 landlords have had a separate disclosure requirement to tenants under SB23-206.

The practical timeline is what matters when a deadline is running. A mitigation install is typically one day. The confirming retest is another two to four days under closed-building conditions. Call it a week from signed bid to documented result, assuming the installer has availability, which in spring and summer is the real constraint.

That is why getting a bid the day the test comes back matters more than getting three bids over a week. Line up availability first, negotiate second.

If you are buying a home that already has a mitigation system, test it anyway. An existing system proves somebody once had a problem, not that the problem is currently solved.
